Information under RTI from Presidents Secretariat.


i)                    Whether my letters dt 7-9-09 (PRSEC/E/2009/06670 dt 8-9-09) and dt 20-10-09 (PRSEC/E/2009/9181 dt 20-10-09) were put up to President or up to what level they were put up and all notings and orders/remarks of various officials may be sent, advising what action was taken thereon, sending copies of notings on these letters and their dealing. It may please be advised, when reply will be sent, giving copies of instructions as to how the representations to President are to be dealt with and reply given by what time to representist. If there are any instructions not to reply representations, the same may please be given.
ii)                  Petition 06670 is shown as sent to Director (P.G.), Department of A.R. Reply from that side is given by lower authority without applying mind to the major issue of not replying any representation but to simply forwarding it to down level and then forgetting about the issue inspite of specific time bound reply for every representation in para 66 of Office Procedure Manual (copy enclosed). This was brought out in PRSEC/E/2009/10510 dt 13-11-09 for which Portal indicates that this is under process in President`s Secretiate. Kindly, advise the position as one year is over to this position, indicating action from time to time with relevant notings.
iii)                For Petition no. 9181, it is shown in Portal that reply is being sent separately by Post/E-Mail (11-1-10). As no reply is received even after 11 months, kindly advise when reply will be given, indicating reasons for such a delay with all relevant notings.  
iv)                Reminder under PRSEC/E/2010/09154 dt 7-6-10 is shown as case disposed of. Kindly, advise reasons for disposing of and who decided under what considerations and why no reasons are advised so far to Applicant. Instructions existing for such disposing of may also be sent.
v)                  Last Petition on this subject under PRSEC/E/2010/09154 dt 7-6-10 is shown in Portal as sent to Jt. Sect (AT & A), who has not given any reply inspite of my reminder to him on E/Mail jsata@nic.in given in portal. Kindly, advise what remedy is provided in our Country to get reply. No reply is received for 4 Petitions to President either from Ministry of Personnel, P.G. & Pension`s any departments nor from Prime Minister`s Office inspite of reminders and reply to first petition is from lower authority without examining the main issue. Grievance noted against Department of Personnel & Training on Portal of Public Grievances No. DOPAT/E/2010/00223 dt 28-8-10 indicates that Case is closed and additional remarks are given that this pertains to DAPRG and not DOPAT. Grievance was against Dept of Personnel & Training, as advised in President`s Portal.
vi)                If this is the position of 2 Petitions to President even after 16 months, please advise what a citizen can do? Come on roads, become Naxalite? This position of Apply, Apply, NO REPLY prevails in the most of Public Authorities at Central, State & Municipal-Panchayat Level. What action is proposed by President of India?
vii)              Kindly advise your E/Mail and E/Mails of your departments. Kindly give details of its working, viz how all E/Mails received are registered and distributed by obtaining acknowledgement etc and whether you wait for hard copy and then only take action, giving copy of relevant circular on this matter.

Extracts of para 66 of the Manual of Office Procedure.
 
66. Prompt response to letters received-
(1) Each communication received from the Member of Parliament, a member of public, a recognized Association  or a Public Body will be acknowledged within 15 days, followed by a reply within 15 days of acknowledge sent.
(2) Where (i) delay is anticipated in sending final reply or (ii) information has to be obtained from another Ministry or another office, an interim reply will be sent within a month (from date of receipt) indicating the possible date by which a final reply can be given.
(3) If any such communication is wrongly addressed to a department, it will be transferred promptly (within a week) to appropriate department under intimation to the party concerned.
(4) Where the request of a member of Public can not be acceded to for any reason, reasons for not acceding to such a request should be given.
(5) As far as possible, requests from members of Public, should be looked at from the user’s point of view and not solely from the point of view of what may be administratively convenient.
